Under New York CPLR §214, the general statute of limitations is three years from the date of the accident. Wrongful death claims must be filed within two years (EPTL §5-4.1). Claims against a New York municipal entity require a Notice of Claim within 90 days. These deadlines are strict, call before they pass.
Case value depends on medical expenses, lost wages, pain and suffering, severity and permanence of injuries, insurance policy limits, and degree of liability. We perform a complete economic and non-economic damages analysis before negotiating with insurers. Every case is different. Yes. New York follows pure comparative negligence (CPLR §1411), meaning you can still recover even if you were partially at fault, your recovery is reduced by your share of fault. A driver found 30% at fault, for example, can still recover 70% of their damages.
Most personal injury cases settle before trial. But insurers settle fairly only when they believe a firm will actually take the case to a jury. Everclad’s partners have substantial New York courtroom experience, which materially changes the settlement conversation.
Straightforward soft-tissue cases often resolve in 6–12 months. Cases involving surgery, permanent injury, or contested liability typically take 18–36 months. Catastrophic injury and wrongful death matters can take longer. Settling too early, before the full extent of injuries is known, is the single most common reason victims under-recover.
